Pure chaos .. I need thoughts..
I am the buyer through Fidelity.
Contract 2023/200, 2024/100 and so on i pay closing costs 102.00 per point at 10,200
Well.. signed contract... sent to ROFR...Disney says that contract has been sold already?!!
Seller gave incorrect information and now they have another contract with more points and obviously want more money. The seller is older and agreed (hasnt signed new contract yet) that she would do the same price for bigger contract.... and her daughter came over and said not so fast...
So waiting for a month signed original contract to find out the seller gave wrong information on previous sold contract.
Is there anything i can do or hold her to or just walk away...

What resort is this? You can likely get a better deal right now than you could have gotten a month ago.
 
Meh, this could happen anywhere. Sounds like this wasn't their fault. If anything, it's the title company.

It wasted a few days, maybe a couple weeks. I just don't see it as a huge deal. Probably better for OP, because prices are dropping.

I disagree - the Broker should be doing REASONABLE due diligence before posting a listing, and do it again before having a Buyer sign a contract. At a minimum, check title online ( Florida:
https://or.occompt.com/recorder/eagleweb/docSearch.jsp which DOES show the contract number for all Direct Sale Deeds at least - and all Deeds show the number of points and Use Year - searchable by name ) plus have the Seller provide documentation (at least a screen shot of their account to check points and so forth). THE BROKERS NEED TO BE SELLING WHAT THEY ARE ADVERTISING. I asked this in the ROFR thread - does anyone actually know what the Brokers DO for Due Diligence to justify their admin fees and commissions?

I am Not saying the OP should fight with the Broker at this point (waste of time) but going forward I'm guessing they (and we) should know EXACTLY what Brokers have done to assure we are getting what they are Selling. Saying "no harm" when someone put up a deposit and waited weeks for documents to clear Disney is not correct.

This does not reflect well on Fidelity - but that does not mean Fidelity is the only one doing a sloppy job?

We can vote on what Brokers do (or do not bother to do) with our pocketbooks :)

Seller had multiple contracts, so Comptroller would show contracts. Then the title company verifies points and specifics with Disney, which is exactly what happened.

A deceptive seller can lie to (or sell from under) any broker. That's why the title company and DIsney verify, which is what happened.

So i am thinking she got confused on what she sold prior and maybe is unorganized or has some dementia. The daughter jsut happeneed to stop by when Fidelity called her and they talked to her then. Just a hot mess.
Now you know the Seller is not entirely competent - I would NOT under any circumstances purchase an additional contract thru her - not because you are being unkind, but because there may be legal issues with whether she has the capacity to sell those contracts at all at this point. You'd need to ask an attorney to be sure. I'd look further - some good deals out there right now so the timing has worked in your favor (even if the stress has not).
 
Walk immediately. You can do so much better right now. This was a blessing in disguise. No way the seller is getting anywhere near that price per point in the market right now. I’m seeing Old Key West going in the 80’s right now on fidelity.

We have purchased several contracts through Fidelity and we really like them. This is an issue that could happen with any broker. I also would just move on. Not a big deal at all. In the end the system worked and caught the title issue.

I would advise that you get your deposit back and use another brokerage. Fidelity is terrible.

I mean, fidelity is literally thousands of dollars less than the board sponsor right now. Some annoyances are worth it.
I was hesitant to use Fidelity but the price was right so I went for it. I have no complaints so far. We’re in ROFR right now and they’ve been as good with communication as the board sponsor was on my previous purchases.

How long did it take for you to get the contract to sign from Fidelity and then after both signed (buyer and seller) how long did it take to go to ROFR? I just looked at another contract there and we agreed on the price. Now waiting for the contract. All started this morning.

We made the offer on Monday, contract Tuesday, and it was submitted to ROFR on Thursday.

I hope you can find a new and even better contract asap! That’s so disappointing.

Submitted offer on 2/8 at 9:00 am, offer accepted 2/8. Signed contract returned by all parties 2/8, 5:00 pm. Earnest money deposit made 2/9, 11:00 am (actually sent first thing, but that's when I got the confirmation). Email notifying contract had been sent to ROFR 10:45 am, 2/10. All times Pacific.

Not too bad at all . 2/17 we signed (buyer) at 5:00pm the seller signed also by 7:30pm. They had our earnest money already from a contract prior that fell through due to seller … I am hoping Monday they send it to ROFR.
 
Feeling a little better … thank you all for the thoughts and advice …found a different contract.
OKW 92.00 per point . 150 points
22/150, 23/150, 24/159 I pay closing costs .
We signed contract 2/17 seller signed Friday night .. now hoping it goes to ROFR by Monday !
