Effective DVC Point Rental Agreements

Should a rental agreement include provision for setting up magical express, and or DDP? Can renters who are non members view a reservation in their My Disney Account, once they have the reservation number provided to them?

The provision on Magic Express & DDP would be up to the owner and whether they want to get involved in that. I don't the contract I use has it mentioned, but I will set it up for my renter if they want it.

Regarding MDE, as soon as you get the reservation # you can add it to your MDE account.

If the renter wants Magical Express, they would need the owner to set it up, correct? Or. Can the renter call and arrange it? As for DDP, does it not need to be added to the reservation so many days prior to check-in? Again, the renter would need the owner to set that up, correct? How would payment for DDP best be handled. As for viewing reservation in MDE, I'm thinking more for the renter. Will the renter be able to pull up the reservation in their own MDE account? I guess it might be peace of mind for the renter since they are working purely on a trust based relationship.

Officially, No. Depending on the CM, the renter might have luck adding it by calling DME directly.

Must be added by the owner at least 2 days prior to check-in date and paid for in full at the time it's added.
How would payment for DDP best be handled.
Having the renter purchase a Gift Card (either Disney GC or one backed by Visa/MasterCard/Amex) for the amount of the Dining Plan is probably one of the best ways. Once the gift card is purchased, the renter can give the owner the gift card number to add and pay for it.
As for viewing reservation in MDE, I'm thinking more for the renter. Will the renter be able to pull up the reservation in their own MDE account? I guess it might be peace of mind for the renter since they are working purely on a trust based relationship.
Using the confirmation number, the renter would be able to link the reservation to their MDE account.

Sorry, I was typing on my phone and did not do a very good job! Members have to set up Magic Express, but I have also heard that anyone can set it up on their own by calling DME directly. If they want Disney Dining Plan, it has to be added by the member either online or by calling MS at least 48 hours before check-in. What I meant to say is that it is up to the member whether they want to 1) put provisions about either in the contract or 2) if they want to get in the middle of a DDP transaction in the first place (ie doing a three way call with MS which means you would hear the renters credit card number which I would not want to do) OR doing it online on your own credit card and having the risk of someone not paying you back). I have never done it for a renter, maybe it is not as complicated as it sounds.

Can the DDP be cancelled off a reservation in the event the renter fails to pay the member? Or is adding DDP a final / non-refundable transaction

1. Who is better protected by Paypal the Member, or Renter?
2. Can Renter ever force a refund through PayPal?
3. If Renter uses a credit card to pay with through PayPal, who pays the credit card fees?
4. If credit card fees are passed on to Member, should Member specify in a rental agreement that a credit card payment is not accepted?

I'm sure there are some more experienced and knowledgeable on paypal than I am but here's the info that I have.
1. Comparatively it appears the buyer/renter is more protected though both have risk. I've seen reports of renters complaining or stating they didn't get what was advertised and having the charges reversed. A renter does have risk, esp if they use a CC, they lose the protections of the CC as I understand it.
2. Potentially.
3. The fees that Paypal uses is technically charged to the person sending the money but they can chose to pass the fee on then the receiver can decide whether to accept the payment and therefor the fee. When I do a rental, I agree to take paypal only if they other party pays the fees. I routinely just ask for a personal check.
4. My view on rental agreements is they should, provide clarity, nothing more for the individual. A company like David's or TSS is a different animal. I'd be clear but being overly complicated can increase the risk. At the end of the day it's unlikely someone would sue from out of state for such relatively few dollars. One of the issues is that if one tries to come up with a very specific and complete document and leaves out something important, you likely increased your risk.

I make the reservation in the renter's name.

Renters.

As the owner you can change the name or cancel the reservation if something falls thru so no need to add a step by doing it first in your name and then changing it. The renter is unable to claim it and make changes in anyway just because it is in their name.

I've rented my points out a long time ago through Disney Dave, but since I've already got the reservation, how can I find someone to sell this reservation to? Thanks!

Edited your post to remove the specifics of the reservation as those may only be posted as part of an offer on the Rent/Trade Board. You may offer your reservation there. But please read the Pinned Thread near the Top of Rent/Trade Board on how to use the rent/trade board before you do so.

I believe David's will now accept confirmed reservations for rent - check his site (www.dvcrequest.com) for more info.
 
I know this is unrelated but perhaps one of you can direct me to the right place. I am looking to rent points from a DVC member jan/feb 2020.....how long should I wait to post about that? spring 2019? Suggestions!?

You need to check the Rent/Trade Board on the DVC Boards. Read every sticky thread at the top of the board before you post anything on that board. You must be logged onto the DIS to even see that board. This is not the place to post a request about information on renting points.
 
This is a great thread. I usually try to rent my points through an outside agency, such as DVC-Rental.com, David's Vacation Rentals, and www.dvcrentalstore.com They all seem to do a good job and the nuances can make a difference sometimes, depending on what you are trying to rent. But there are also times when I need to try to rent out my points or reservations directly and this board has been so helpful in that. I love the great advice that people are willing to share, and it not only helps me, but helps the people who I rent to, making more Magical vacations for all.
